Ontario Nominates Marg Creal as Chair of Consent and Capacity Board

The Ontario government has nominated Marg Creal as Chair of the Consent and Capacity Board, who is expected on March 11th to replace Justice Richard D. Schneider.

Ms. Creal is an experienced criminal trial counsel who has served as an Assistant Crown Attorney in Toronto for 27 years. In that time she has developed significant expertise in dealing with accused persons with mental illness. She has appeared regularly before the Ontario Review Board and in Drug Treatment Court. She also played a role in the development of and has appeared regularly before the Mental Health Court. She is also a member of the Ministry of the Attorney General’s Mental Health and Justice Advisory Committee.

Through her experiences in law and mental health, Ms. Creal has worked with stakeholders in justice, health care, social services, policing and corrections. She has knowledge of the many significant health, social and legal challenges faced by persons with mental health issues, and is frequently called upon to speak at educational events related to mental disorder and the law.

Ms. Creal was co-counsel to the Coroner in the Inquest into the death of Ashley Smith. The inquest examined complex issues faced by an inmate with severe mental illness and the institution that had care of her, in order to find potential solutions.

The Consent and Capacity Board is an independent body created by the provincial government of Ontario under the Health Care Consent Act. It conducts hearings under the Mental Health Act, the Health Care Consent Act, the Personal Health Information Protection Act, the Substitute Decisions Act and the Mandatory Blood Testing Act. Board members are psychiatrists, lawyers and members of the general public appointed by the Lieutenant Governor in Council.
