Regulation under the Long-Term Care Homes Act, 2007

The Regulation under the Long-Term Care Homes Act, 2007 (LTCHA) has now received approval and will be effective on July 1, 2010 when the LTCHA comes into force.

In May and September 2009, the Minister of Health and Long-Term Care invited written comments on the first and second sets of proposed initial draft regulations under the LTCHA. All comments received during the public consultation periods were reviewed and considered in the development of the Regulation.

At the time of proclamation of the LTCHA, the current legislation governing long-term care homes (The Nursing Homes Act, Charitable Institutions Act and Homes for the Aged and Rest Homes Act) would be repealed and the accompanying regulations would be revoked. The current Long-Term Care Homes Program Manual containing inspection standards, criteria and policies would no longer apply.

The Regulation is now available in English and French on the e-Laws website, on the Regulatory Registry and will be available in the Ontario Gazette .

The Ministry of Health and Long-Term Care is asking all Long-Term Care home licensees to make a copy of this material available in their home and to provide a copy to both the Residents’ and Family Councils. All Local Health Integration Network (LHIN) offices are also being asked to make copies available for members of the public.
